1. Collection
Walsh Halligan Douglas will not collect personal information unless it is necessary for one or more of its functions or activities. The information will be collected lawfully and fairly, and not in an unreasonably intrusive way. Walsh Halligan Douglas will take reasonable steps to ensure that when collecting personal information the individuals are aware of :
(a) the identity of Walsh Halligan Douglas;
(b) the fact that he/she is able to gain access to the information;
(c) the purpose for collecting the information;
(d) the organisations to which that information is usually disclosed;
(e) any law that requires the information to be collected; and
(f) consequences (if any) for the individual if the information is not provided.
Walsh Halligan Douglas will insofar as reasonably possible collect the information from the individual himself or herself. If this is not possible and the information is collected from someone else, Walsh Halligan Douglas will take reasonable steps to ensure the individual is made aware of the matters listed above, unless specific exemptions apply. Sensitive information will only be collected with the individual's consent, unless sepcific exemptions apply.
2. Use and Disclosure
The general rule is that Walsh Halligan Douglas will not use or disclose personal information about an individual other than for the purpose stated at the time of collection. If another use is proposed, it will seek further consent, unless that other purpose is related to the original purpose of collection.
3. Data Quality
Walsh Halligan Douglas will reasonably ensure that the personal information it collects, uses or discloses is accurate, complete and up to date. When the information is no longer needed, Walsh Halligan Douglas will take reasonable steps to destroy or permanently de-identify personal information.
4. Data Security
Reasonable steps are taken by Walsh Halligan Douglas to protect the personal information it holds from misuse and loss, and from unauthorised access, modification or disclosure.
5. Openness
Walsh Halligan Douglas has documented policies on management of personal information. This information will be made available on request.
6. Access and Correction
The general rule is that Walsh Halligan Douglas will give individuals access to their personal information. It will correct it on request, except in certain circumstances. If it does not make a correction, it may provide an explanation on the record.
7. Identifiers
Walsh Halligan Douglas will not use a government agency identifier as its own identifier to link people with information.
8. Anonymity
Where lawful and practical, Walsh Halligan Douglas will give an individual the option of not identifying themselves when dealing with it.
9. Trans-Border Data Flows
Walsh Halligan Douglas will only transfer information about an individual to a foreign country with less privacy protection in specified circumstances.
